These Terms outline the agreement between you (the savvy, well-groomed, skincare-respecting user) and Kelgavian Forge. If you browse, shop, or even pause on our site, you’re agreeing to these Terms. If you don’t agree, do not use the Service.

Any new features, tools, scent selectors, or product launches added to the Service are also subject to these Terms. These Terms apply to all users, including browsers, vendors, customers, merchants, and content contributors. SECTION 1 – ONLINE STORE TERMS

You affirm that you’re at least the age of majority in your state (or have a legal guardian’s permission). You may not use the Service or products for any illegal or unauthorized purpose, and you must not violate any laws in your jurisdiction (including copyright). You must not transmit viruses, worms, or malicious code. Any breach of these Terms may result in immediate termination of your right to access or use the Service.

SECTION 2 – GENERAL CONDITIONS

Right to Refuse. We may refuse service to anyone, at any time, for any lawful reason. Fraud, harassment, or abuse gets the flame snuffed—fast.

Data in Transit. Content you submit (excluding payment details) may be transmitted unencrypted over networks to adapt to technical requirements. Payment information is always encrypted and transferred using industry-standard security protocols.

Intellectual Property. All content on the Service—formulas, descriptions, images, copy—is proprietary to Kelgavian Forge or our licensors. You may not reproduce, duplicate, sell, exploit, or remix any portion of the Service or its content without our express written permission or as otherwise permitted by applicable terms.

Clarity. Using the Service means you agree to these Terms and any linked policies. No fine-print tricks; just straight talk.

SECTION 3 – ACCURACY & TIMELINESS OF INFORMATION

We aim for accuracy across product details, pricing, and stock status. Errors may occur (typos, outdated info, backorders, etc.). We reserve the right to correct errors or omissions (including after an order is placed), and to update information without prior notice. We are not obligated to update any information unless required by law. Archived content may remain visible as a historical artifact.

By using the site, you acknowledge it’s your responsibility to stay informed about changes.

SECTION 4 – SERVICE & PRICING MODIFICATIONS

Prices change. Scents rotate. Products may launch or retire without notice. We aren’t liable for modifications, price changes, suspensions, or discontinuations. New tools or features are also subject to these Terms.

SECTION 5 – AVAILABILITY, DROPS & DISCLAIMERS

All products (including beard care, skincare, and candle-based products) are subject to availability. Some items are seasonal, limited, or exclusive.

We reserve the right to:

  • Limit purchases (by person, household, order, or address);

  • Cancel orders we suspect are fraudulent or for resale;

  • Discontinue any product at any time, at our discretion.

Product images and colors are displayed as accurately as possible, but screens differ. Color may vary; the vibe won’t. We do not guarantee products will meet your expectations in every respect.

SECTION 5A – FRAGRANCE DISCLAIMER

Certain Kelgavian Forge products feature fragrance profiles inspired by popular or designer scents. These comparisons are provided for reference only to help describe general fragrance families.

Kelgavian Forge is not affiliated with, endorsed by, or connected to any designer brand or trademark mentioned. All trademarks, product names, and company names are the property of their respective owners. Comparisons do not imply duplication, endorsement, or association.

SECTION 6 – BILLING & ACCOUNT INFORMATION

Provide current, complete, and accurate purchase and account information. Update your account details (email, billing address, credit card numbers, and expiration dates) promptly to complete transactions and for necessary contact. We may cancel or flag orders that appear inaccurate or suspicious.

SECTION 7 – THIRD-PARTY SERVICES & INTEGRATIONS

We may provide access to third-party tools, content, or services (“Third-Party Services”) that we do not control. These are provided as-is and as available without warranties or endorsements. Your use is at your discretion and governed by the third party’s terms and policies.

If you access our Service through Apple, Android, or other platforms, you are also subject to those platforms’ terms. We are not responsible for their operations and do not provide support for their systems.

Terms Specific to Apple Users

  • These Terms are between you and Kelgavian Forge, not Apple.

  • Your use of our app must comply with Apple’s App Store Terms and applicable third-party agreements.

  • Kelgavian Forge is responsible for the app and its content; Apple has no obligation to provide maintenance or support.

  • Apple provides no warranties beyond what is required by law.

  • Any legal claims (product liability, compliance, consumer protection) are directed to us.

  • Any intellectual property claims related to the app are our responsibility.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

  • Real-time data (e.g., location) may be inaccurate; use at your own risk.

We use Third-Party Services (e.g., Shopify, PayPal) and are not liable for how they operate. Review their terms for details.

SECTION 8 – THIRD-PARTY LINKS

Links on the Service may direct you to third-party sites. We are not responsible for their content or policies. Access at your own risk.

SECTION 9 – COMMENTS, FEEDBACK & USER-GENERATED CONTENT (UGC)

By tagging, messaging, reviewing, or otherwise submitting content to us, you grant us permission to use, repost, share, and market that content, with or without attribution, and without obligation to compensate you.

Do not post hateful, harmful, or spam content. We reserve the right to moderate or remove content that violates these Terms or the law.

SECTION 10 – PERSONAL INFORMATION & COMMUNITY CONDUCT

Personal information submitted through the Service is governed by our Privacy Policy.

UGC Ownership. You must own or have permission to post any content you submit (photos, comments, reviews).
People in Photos. Only upload images featuring people who have given permission.
Conduct. Be respectful; no harassment, hate speech, threats, or obscene content. No exploitation of minors.
Prohibited UGC Actions. No self-promotion/selling, spam, harvesting contact info, soliciting sensitive info, impersonation, false or misleading content, doxxing, or uploading malware.
Public Spaces. Community content is public—don’t share sensitive information.
Disclosure. If you receive compensation, a gift, or an incentive from us, disclose it clearly as required by law.
Our Rights. We may remove content that violates these rules and request proof of your rights to post it.

SECTION 11 – ERRORS, INACCURACIES & OMISSIONS

Information on the Service may contain errors relating to descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct errors and update information at any time without prior notice (including after an order is submitted). We are not obligated to update information except as required by law.

SECTION 12 – PROHIBITED USES

In addition to other prohibitions in these Terms, you may not use the Service or its content to:
(a) engage in unlawful activity; (b) solicit others to perform unlawful acts; (c) violate laws or regulations;
(d) infringe intellectual property rights; (e) harass, abuse, insult, harm, defame, slander, intimidate, or discriminate;
(f) submit false or misleading information; (g) upload or transmit malware; (h) collect or track others’ personal information;
(i) spam, phish, pharm, pretext, spider, crawl, or scrape; (j) act obscenely or immorally;
(k) interfere with or circumvent security features of the Service or any related website.
We may terminate your use of the Service for violations.

SECTION 13 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable. The Service and all products provided through it are offered “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement.

In no event shall Kelgavian Forge, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any indirect, incidental, punitive, special, or consequential damages of any kind (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Service or any products obtained through it, even if advised of the possibility. Some jurisdictions do not allow certain limitations; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

SECTION 14 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Kelgavian Forge and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or related documents, or your violation of any law or third-party rights.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed. The remainder of the Terms shall remain in full force and effect.

SECTION 16 – TERMINATION

Obligations and liabilities incurred prior to termination survive termination. These Terms are effective unless and until terminated by you or us. You may terminate by ceasing use of the Service and notifying us. If, in our judgment, you fail—or we suspect you have failed—to comply with any provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to the date of termination. We may deny you access to the Service (or any part of it).

SECTION 17 – ENTIRE AGREEMENT

These Terms, together with any policies or operating rules posted by us on the site or in respect to the Service, constitute the entire agreement between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals (oral or written). Failure to enforce any right or provision shall not constitute a waiver. Any ambiguities shall not be construed against the drafting party.
